Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the SwaMind mobile apps, web dashboard at https://dashboard.swamind.com, and website at https://swamind.com (the "Service"), owned and operated by SwaMind Systems Pvt Ltd ("SwaMind Systems," "we," "us," or "our"). SwaMind is the product brand of SwaMind Systems Pvt Ltd. By creating an account or using the Service, you agree to these Terms and our Privacy Policy.

1. Eligibility

• You must be able to form a binding contract in your jurisdiction, or use SwaMind under a parent, guardian, or school account as permitted.
• If you use SwaMind through a school or organization, you also agree to that institution's rules and any agreement between SwaMind and the institution.
• You are responsible for the accuracy of information you provide when registering.

2. The Service

SwaMind is a premium mental fitness program offering micro-courses, daily check-in practices, progress tracking, and related tools to help users build focus, resilience, and positive habits. Features may vary by plan, device, region, or institutional license.

Important: SwaMind provides educational and personal development content. It is not medical care, psychotherapy, crisis counseling, or a substitute for professional mental-health advice. If you are in crisis or need clinical support, contact local emergency services or a qualified professional.

3. Accounts

• Keep your login credentials confidential and notify us of unauthorized use.
• You are responsible for activity under your account, except where caused by our failure to secure the Service.
• We may suspend or terminate accounts that violate these Terms or pose a security risk.
• You may delete your account as described on our Account Deletion page.

4. Subscriptions and payments (SwaMind Pro)

• Some features require a paid subscription or institutional license ("Premium" / "Pro").
• Mobile subscriptions are typically billed through the Apple App Store or Google Play. Their billing terms, refund rules, and tax handling apply to store purchases.
• Subscriptions may auto-renew until cancelled in your store account settings or as otherwise offered in-app.
• Prices and plan features may change; we will communicate material changes as required by law or store policy.
• Institutional or web billing may be handled separately under a school or organization agreement.

5. License and intellectual property

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal or authorized educational purposes. SwaMind content, branding, software, courses, and designs remain our property or that of our licensors. You may not copy, reverse engineer, scrape, resell, or redistribute the Service except as allowed by law or written permission.

6. User content

You retain ownership of reflections, journal-style entries, and other content you submit ("User Content"). You grant SwaMind a worldwide license to host, process, and display User Content as needed to operate the Service (including syncing across your devices and showing progress to authorized teachers/admins when linked to a school program). You represent that you have the rights to submit User Content and that it does not violate law or others' rights.

7. Acceptable use

You agree not to:

• Harass, harm, or exploit others, especially minors
• Upload unlawful, abusive, or infringing content
• Attempt to access other users' accounts or private data
• Interfere with Service security, integrity, or performance
• Use bots, scrapers, or automated means without permission
• Misrepresent your identity or affiliation
• Use the Service for clinical diagnosis or emergency response

8. Schools and organizations

If you administer SwaMind for a school or organization, you represent that you are authorized to do so, will configure access appropriately, and will handle student data in line with applicable education and privacy laws and your institution's policies.

9. Third-party services

The Service may integrate third-party tools (for example authentication, analytics, or subscription validation). Your use of those services may be subject to their terms.

10. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee uninterrupted availability or specific outcomes from using mental fitness practices.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SWAMIND SYSTEMS PVT LTD AND ITS AFFILIATES WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL. OUR TOTAL LIABILITY FOR CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID TO US FOR THE SERVICE IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50, EXCEPT WHERE LIABILITY CANNOT BE LIMITED BY LAW.

12. Indemnity

You agree to defend and indemnify SwaMind Systems Pvt Ltd against claims arising from your misuse of the Service, your User Content, or your violation of these Terms, except to the extent caused by our gross negligence or willful misconduct.

13. Termination

You may stop using the Service at any time and delete your account. We may suspend or end access if you breach these Terms, if required by law, or if we discontinue the Service. Sections that by nature should survive (including IP, disclaimers, and liability limits) will survive termination.

14. Changes

We may update these Terms periodically. Continued use after changes become effective constitutes acceptance, except where local law requires additional consent.

15. Governing law

These Terms are governed by the laws of India as applicable to SwaMind Systems Pvt Ltd, without regard to conflict-of-law rules, unless mandatory consumer protections in your country provide otherwise.
